Christof Koch and Klaus Hepp, in a recent essay in this journal1, issued a challenge to “those who call upon consciousness to carry the burden of the measurement problem in quantum mechanics.” Lest absence of a response be construed as admission of a failure of the idea that consciousness can play, via quantum measurement effects, a crucial role in neurodynamics, or that this idea has been in any rational way damaged by the arguments put forth in the cited article, I (...) respond here to that challenge. Paget introduces the general reader to Afro-Caribbean philosophy in this ground-breaking work. Since Afro-Caribbean thought is inherently hybrid in nature, he traces the roots of this discourse in traditional African thought and in the Christian and Enlightenment traditions of Western Europe.

Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

Some of our most fundamental moral rules are violated by the practices of torture and war. If one examines the concrete forms these practices take, can the exceptions to the rules necessary to either torture or war be justified? Fighting Hurt brings together key essays by Henry Shue on the issue of torture, and relatedly, the moral challenges surrounding the initiation and conduct of war, and features a new introduction outlining the argument of the essays, putting them into context, (...) and describing how and in what ways his position has modified over time. The first six chapters marshal arguments that have been refined over 35 years for the conclusion that torture can never be justified in any actual circumstances whatsoever. The practice of torture has nothing significant in common with the ticking bomb scenario often used in its defence, and weak U.S. statutes have loop-holes for psychological torture of the kind now favoured by CIA in the 'war against terrorism'. The other sixteen chapters maintain that for as long as wars are in fact fought, it is morally urgent to limit specific destructive practices that cannot be prohibited. Two possible exceptions to the UN Charter's prohibition on all but defensive wars, humanitarian military intervention and preventive war to eliminate WMD, are evaluated; and one possible exception to the principle of discrimination, Michael Walzer's 'supreme emergency', is sharply criticized. Two other fundamental issues about the rules for the conduct of war receive extensive controversial treatment. The first is the rules to limit the bombing of dual-use infrastructure, with a focus on alternative interpretations of the principle of proportionality that limits 'collateral damage'. The second is the moral status of the laws of war as embodied in International Humanitarian Law. It is argued that the current philosophical critique of IHL by Jeff McMahan focused on individual moral liability to attack is an intellectual dead-end and that the morally best rules are international laws that are the same for all fighters.Examining real cases, including U.S. bombing of Iraq in 1991, the Clinton Administration decision not to intervene in the 1994 Rwandan genocide, NATO bombing of Serbia in 1999, and CIA torture after 9/11 and its alternatives, this book is highly accessible to general readers who are interested in the ethical status of American political life, especially foreign policy. The article addresses issues at the nexus of physician industrial action, moral agency, and responsibility. There are situations in which we find ourselves best placed to offer aid to those who may be in vulnerable positions, a behavior that is consistent with our everyday moral intuitions. In both our interpersonal relationships and social life, we make frequent judgments about whether to praise or blame someone for their actions when we determine that they should have acted to help a vulnerable person. (...) While the average person is unlikely to confront these kinds of situations often, those in the medical professions, physicians especially, may confront these and similar situations regularly. Therefore, when physicians withhold their services for whatever reason in support of industrial action, it raises issues of moral responsibility to patients who may be in a vulnerable position. Using theories of moral responsibility, vulnerability, and ethics, this paper explores the moral implications of physician industrial action. We explore issues of vulnerability of patients, as well as the moral responsibility and moral agency of doctors to patients. Determining when a person is vulnerable, and when an individual becomes a moral agent, worthy of praise or blame for an act or non-action, is at the core of the framework. Notwithstanding the right of physicians to act in their self-interest, we argue that vulnerability leads to moral obligations, that physicians are moral agents, and the imperatives of their obligations to patients clear, even if limited by certain conditions. We suggest that both doctors and governments have a collective responsibility to prevent harm to patients and present the theoretical and practical implications of the paper. (shrink)

Due to the prevalence, severity, and costs associated with autism spectrum disorders, it has become a public health issue. In response, state governments have adopted ASD-specific private insurance mandates requiring coverage of ASD screening, diagnosis, and treatment. Despite rapid uptake of these laws, differences exist in the type and levels of coverage, especially for allied health services including occupational therapy. We piloted a structured legal research methodology to code ASD insurance mandates that impact allied health service provisions. State private insurance (...) mandates were obtained from WestlawNext. A coding methodology was piloted on 14 states and included variables for age and service limits, treatments covered, and medical necessity. Coding methods were feasible and highly reliable among raters. Ten of 12 states had a coverage mandate, many with specific provisions for allied health providers. A full analysis of all 50 states is warranted to identify provisions affecting allied health providers serving individuals with ASD. (shrink)

Resolution of the problem of mass nouns depends on an expansion of our semantic/ontological taxonomy. Semantically, mass nouns are neither singular nor plural; they apply to neither just one object, nor to many objects, at a time. But their deepest kinship links them to the plural. A plural phrase — 'the cats in Kingston' — does not denote a single plural thing, but merely many distinct things. Just so, 'the water in the lake' does not denote a single aggregate — (...) it is not ONE, but rather MUCH. The world is not the totality of singular objects, plural objects, and mass objects; for there are no plural or mass objects. It is the totality of single objects and (just) stuff. (shrink)

Confederate service, Confederate propaganda. Although not born in the South, Henry Hotze's devotion to the cause of the Confederacy was as ardent as that of any native secessionist. As a member of the Mobile Cadets, an elite volunteer company of the Gulf City, Hotze was ordered to Virginia at the start of war as part of the Third Alabama Regiment. He distinguished himself in many ways, primarily off the battlefield as a clerk and European go-between. In November of 1861, (...) he was appointed to the position of Commercial Agent at London by C.S.A. Secretary of State R.M.T. Hunter, who instructed him to take the pulse of the English public on Confederate sentiment and to publish articles there that would cast the Confederacy in a favorable light. These articles appeared first in The Index, the newspaper that Hotze established in London, and reveal Hotze's skill as both a reporter and a propagandist for the Confederacy. (shrink)

Michael S. Gazzaniga is a renowned cognitive neuroscientist. He was Editor-in-Chief of the 1447 page book The Cognitive Neurosciences, which, for the past decade, has been the fattest book in my library, apart from the ‘unabridged’. His recent book The Ethical Brain has a Part III entitled “Free Will, Personal Responsibility, and the Law”. This Part addresses, from the perspective of cognitive neuroscience, some of the moral issues that have been dealt with in the present book. The aim of this (...) Part III is to reconcile the materialist idea that brain activity is determined with the notion of moral responsibility, which normally depends upon the idea that we human agents possess free will. This book re-evaluates New Left and Marxist texts from the 1980s, in order to explore problems facing the study of 'class' which have emerged within Australian and international theories. The author contrasts the popular ideas of Connell, Bourdieu and the 'Death of Class' thesis, with those of lesser known texts, concluding that no single definition can account for the various historical meanings of class. Instead, loosely following Castoriadis, the concept of class can best be understood as creatively imagined and institutionalised. (...) Paternoster proposes that class is best studied through historical phenomenology, which can be used to link political economy, cultural sociology and anthropological ethnographies. This approach allows the contributions of Marxist and New Left authors to be reintegrated with contemporary theories. Doing so highlights the significance of labour populism, while cautioning against the ahistorical applications of texts such as Boudieu's Distinction. Reimagining Class in Australia will be of interest to students and scholars across a range of disciplines, including sociology, history, political economy and anthropology. (shrink)
